Terms of Service

These Terms of Service ("Terms") govern your use of the Apex Automation platform operated by GetApexAutomation LLC ("Apex," "we," "us," "our") at getapexautomation.comand related services (collectively, the "Service"). By creating an account, paying for the Service, or accessing your dashboard, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

Apex Automation is an AI phone receptionist for garage-door companies. The Service answers your business calls 24/7 on a dedicated phone number (or on your existing number via call forwarding), books appointments onto your calendar during the conversation, records and transcribes calls, and emails booking confirmations with calendar invites (.ics) so events add to any calendar app in one tap — Google, Apple, Outlook. The customer receives an email confirmation; you (the account holder) receive an email and a text alert for each booking, sent from Apex's own notification number.

Apex does not build or host customer-facing websites.

2. Account Eligibility

You must be at least 18 years old and have authority to bind your business to these Terms. You agree to provide accurate account information and keep it current. You're responsible for all activity on your account.

Free trial: No charge occurs during the 14-day free trial, so there is nothing to refund. Paid months: Apex offers a 30-day money-back guarantee from your first paid month — if Apex doesn't earn its keep, every monthly fee paid is refunded. Full terms in our Refund Policy.

5. Acceptable Use + Fair Use

You agree NOT to use the Service to:

Fair-use clause.Your flat monthly plan covers ordinary business call volume from your real end customers. If we detect bot/scraper bursts, automated dialing, or sustained traffic patterns that don't match legitimate end-customer behavior, we reserve the right to (a) limit or throttle the affected traffic, (b) ask you to resolve the abuse, or (c) suspend or terminate Service if abuse continues.

We may suspend or terminate accounts that violate these terms.

6. Your Phone Number

As part of the Service, we provision a dedicated phone number through Twilio for your AI Voice Agent — or, if you choose to keep your existing business number, we help you set up call forwarding to your AI line. The phone number is leased on your behalf for the duration of your subscription; if you cancel, the number is released.

6a. Text Messaging (SMS)

Program description. Apex Automation operates one text-messaging program. We send account- and booking-notification text messages — for example, an instant alert the moment your AI Voice Agent books a job, plus occasional account or service notices — to you, the account holder (the shop owner). All messages come from Apex Automation's own dedicated phone number, registered under our A2P 10DLC sender. We do not text your end customers; your customers always receive their booking confirmations and calendar invites by email. There is nothing for you or your customers to register or verify.

Opt-in. You opt in to this program by entering your mobile number and checking the consent box on the signup form. Message frequency varies and depends on how often jobs are booked. Message and data rates may apply, charged by your mobile carrier, not Apex. These are transactional messages, not marketing.

Opt-out. Reply STOP to any message to unsubscribe at any time (we then stop all further texts to that number); reply HELP for help. We will never sell or share your mobile number or your SMS opt-in / consent information with third parties or affiliates for marketing. 7. AI Disclaimer

The AI Voice Agent is not perfect. Like any AI system, it may occasionally produce inaccurate, incomplete, or inappropriate responses. You acknowledge that:

7a. Voice Call Recording

To do its job, the AI Voice Agent records and transcribes the phone calls it answers. Calls are recorded and processed for you so the agent can understand the caller, book the job, write an accurate summary, and let you review what was said. Recordings + transcripts are accessible to you in your dashboard and to Apex administrators for support.

9. Intellectual Property

Apex, the Service, the website at getapexautomation.com, the dashboard, the AI agent software, and all related logos and content are our property and protected by copyright/trademark law. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service while your subscription is active.

You own the content you submit. On cancellation, an export is available on request and your data is retained per the schedule in our Privacy Policy.

10. Service Availability

We aim for high availability but don't guarantee uninterrupted Service. Scheduled maintenance, third-party outages (Stripe, Anthropic, Render, Supabase, Cloudflare), and force majeure events may cause downtime. We are not liable for damages from such interruptions.

11. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes to the Terms will be communicated via email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

Pricing changes for active subscriptions will be communicated at least 30 days in advance and will not affect your current billing period.

12. Termination

You may terminate at any time by canceling from your dashboard. We may terminate or suspend your account if you violate these Terms, fail to pay, or for any reason with 30 days' notice. Upon termination, your access ends and your data is retained per our Privacy Policy.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT THE AI VOICE AGENT'S RESPONSES WILL BE ACCURATE OR APPROPRIATE FOR YOUR BUSINESS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law, or (d) content you provide to the Service (business profile data, FAQs, customer contact records, and voice call recordings) that infringes third-party rights or is otherwise unlawful.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved as follows:
